Terms of Service

These terms govern your use of the NeedHuman API and related services ("Service"). By using the Service, you agree to these terms. If you do not agree, do not use the Service.
The Service is operated by Marius Bergvik Aure ("Provider", "we", "us"). The operating entity may change to a Norwegian aksjeselskap (AS) upon registration. Updated entity details will be reflected here.
1. How It Works
You describe a task. A human worker performs it. You get the result. The Service is built for AI agents and developers who need a human in the loop.
You submit task descriptions via our API or MCP tools. A human worker attempts to perform the described task and returns a result, along with proof of completion (text description and/or URL) when applicable. Common tasks include creating accounts, accepting terms of service, completing forms, verifying information, and other actions that require a human. Most tasks are completed within minutes to hours.
The Service is best-effort. We do not guarantee that any task will be completed, that it will be completed within a specific timeframe, or that the result will be accurate. We do not verify the legality of tasks you submit — that responsibility is yours.
2. The Deal
You authorized the task, so you own the outcome. This is the core principle behind these terms:
- You decide what tasks to submit. You are responsible for ensuring your tasks are lawful.
- We make a reasonable effort to perform them. We are responsible for performing tasks with reasonable care.
- If something goes wrong because of what you asked for, that is on you. If something goes wrong because of how we performed it, that is on us (subject to the liability limits below).
3. Your Responsibilities
By submitting a task, you represent that:
- The task complies with all applicable laws in all relevant jurisdictions.
- You have the authority to request the described actions. If you are an AI agent acting on behalf of a principal, your principal has authorized the request.
- The task does not require a worker to misrepresent their identity, impersonate another person, or provide false information.
- The task does not involve fraud, money laundering, sanctions evasion, or other criminal conduct.
- Any credentials or personal information you include in a task description are shared at your own risk. See section 7 for how we handle your data.
- You will verify the accuracy of results before relying on them.
4. Tasks We Will Not Perform
We may decline or abandon any task at our discretion. The following are expressly prohibited. Listing these does not create an obligation for us to screen tasks before performing them:
- Identity fraud, impersonation, or misrepresentation.
- KYC or AML verification using a worker's own identity on your behalf.
- Financial crimes or money laundering.
- Any task that violates criminal law.
- Accessing systems where authorization has been revoked (e.g., after a cease-and-desist or account ban).
5. Liability
The Service is provided "as is" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Our total liability for all claims arising from the Service — regardless of legal theory — is limited to the fees you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility.
These limits do not exclude liability for our gross negligence or willful misconduct where applicable law prohibits such exclusion.
6. Indemnification
Because you authorize each task, you are responsible for the consequences. If a third party brings a claim against us because of a task you submitted, you agree to indemnify, defend, and hold harmless the Provider, its owners, workers, and contractors from all damages, losses, and expenses (including reasonable legal fees) arising from:
- Tasks you submitted or directed.
- Your use of the Service in violation of these terms.
- Your violation of applicable law.
- Claims by third-party platforms arising from actions performed at your request.
This obligation survives termination.
7. Data
Tasks may require you to share credentials or sensitive information. We use this information to perform the requested task. Task data, including everything in task descriptions, is retained as part of our operational records. Only include information necessary to complete the task.
We take reasonable measures to protect information in our systems but do not guarantee immunity from unauthorized access. We are not liable for breaches except to the extent caused by our gross negligence or willful misconduct.
8. Third Parties and Relationships
Tasks often involve third-party platforms. We are not affiliated with or responsible for any third-party platform and are not liable for their actions, including account suspension, data loss, or other consequences.
These terms do not create an employment, partnership, or agency relationship between you and the Provider or any worker. Workers are not your employees or agents.
9. Credits and Termination
New API keys include free credits to try the Service. Credits are consumed when a task is submitted.
Either party may stop using or providing the Service at any time. We may suspend your API key or decline tasks if we believe you are violating these terms or if continuing would expose us or our workers to unacceptable risk.
10. General
These terms are governed by Norwegian law. Disputes shall be resolved by Oslo District Court (Oslo tingrett).
If any provision is held unenforceable, the rest remains in effect. We may update these terms; continued use after changes constitutes acceptance. These terms are the entire agreement between you and the Provider regarding the Service.
